Overview

The Environmental Protection Act (1990) imposes a Duty of Care on the handling of waste, which affects anyone who:

produces
imports
stores
transports
treats
recycles
or disposes of controlled waste

The primary onus of responsibility for the handling of waste is on the waste producer, who must ensure that wastes are stored securely and that they are transferred to an "authorised" person only.

Any waste transfer must be accompanied by a written waste transfer note in which the waste is sufficiently and accurately described.
